Terms and conditions.
These terms apply when you use bldwell.com, book a call with us, or receive our emails and text messages. They're an agreement between you and YDR LLC, doing business as BLDWELL ("we" and "us"). By using the site or booking a call, you agree to them.

You must be 18 or older
You must be at least 18 years old to use this site, book a call with us, or sign up for our text messages or emails. By using the site, you confirm that you are 18 or older.
Using the site
You're welcome to browse the site, read our blog and case studies, and book a call. Please don't misuse it: don't try to break into it or overload it, copy it in bulk, send spam through its forms, or book calls in someone else's name. We may block access that looks like abuse.
Strategy calls
Strategy calls are free and come with no obligation. Please give accurate details when you book. If we need to move or cancel a call, we'll tell you and offer a new time. What we discuss on a call, including ideas, estimates and plans, is for discussion only and isn't a binding offer.
Paid work
Paid projects are governed by the signed Master Custom Software Development Agreement and the Statement of Work for that project. If anything in these terms conflicts with a signed agreement, the signed agreement wins.
Text messages (SMS)
BLDWELL sends text messages only to people who agreed to receive them by ticking a box on one of our forms. There are two kinds, each with its own box:
- Call and project texts: booking confirmations, call reminders, follow-ups about your inquiry, and updates on proposals, signing and payments.
- Marketing texts: news about our custom software, automation and AI systems, special offers, new case studies and event invitations, sent only if you ticked the marketing box.
You must be 18 or older to sign up for texts. Agreeing to texts is not a condition of booking a call or buying anything from us.
- How often: message frequency varies. Call and project texts follow your bookings and our work together; marketing texts are occasional.
- Cost: message and data rates may apply for any messages we send you and you send us. If you have questions about your text or data plan, contact your wireless provider.
- Stopping: you can cancel the SMS service at any time. Just text "STOP" to the number that texted you. After you send "STOP", we'll send you one message to confirm that you've been unsubscribed, and after that you won't receive SMS messages from us. If you want to join again, sign up as you did the first time and we'll start sending you SMS messages again.
- Help: if you're having trouble with our messages, reply with the keyword "HELP" for more assistance, or get help directly at hello@bldwell.com.
- Carriers are not liable for delayed or undelivered messages.
- Privacy: if you have any questions about privacy, please read our Privacy policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Emails
We email you about calls you book and work we do together. We may also send occasional news about our services. Every marketing email has an unsubscribe link.
What you send us
When you send us information, you confirm that it's accurate and that you're allowed to give it, and that any phone number you enter is yours or one you're authorized to use. Our Privacy policy explains how we handle it.
Our content
The site's text, design and images, the BLDWELL name and logo, our mascot, and our blog posts and case studies belong to BLDWELL or to the people who licensed them to us. You may read them, link to them, and quote short parts with credit. Please don't copy the site or use our brand without our written permission. Who owns the work we build for a client is set by that client's signed agreement.
Results vary
The case studies, figures and examples on the site describe what happened for particular businesses. Your results depend on your business and will vary. Nothing on the site promises a particular outcome, and none of it is legal, tax or financial advice.
Other services
The site links to and includes services run by others, such as booking calendars, video players and video calls. Their own terms and privacy policies apply to them, and we aren't responsible for them.
Disclaimers
The site and its content are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the site will always be available or free of errors.
Limits on our liability
To the fullest extent the law allows, BLDWELL isn't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, income or data, arising from your use of the site, our calls, or our emails and texts. Our total liability for any claim about them is limited to $100. These limits don't apply to paid work, which the signed agreement covers, or where the law doesn't allow them.
Governing law
These terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any court proceeding arising from them will be brought in a state or federal court having jurisdiction in or over Spokane County, Washington, and you and we consent to that jurisdiction and venue.
Changes to these terms
We may update these terms. The date at the top shows when they last changed. Changes apply from when they're posted, but not to a dispute that started before then. If a change is significant, we'll note it on the site.
